1. Who we are
Velvet is run by Capacity Entertainment LLC (“Capacity”, “we”, “us”). Promoters, artists and their teams (“Organizers”) use Velvet to run presale signups and share show news. These terms cover your use of Velvet signup pages, the Velvet fan page, and the texts and emails we send for Organizers (together, the “Service”). By using the Service, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
2. Age
You must be at least 13 to use the Service. If you are under 18, you need a parent’s or guardian’s permission. Some presales are 18+ or 21+, and the Organizer decides that.
3. Signing up
Give accurate information and sign up only for yourself, once per presale. Don’t use fake or someone else’s email addresses or phone numbers, or automated tools. We and the Organizer may remove signups that break these rules or look like abuse. That includes duplicate, bot or resale-driven signups.
4. Presale codes and tickets
- Signing up does not guarantee a code, a ticket, or a seat. Codes are often limited and may be given by lottery, location or other rules the Organizer sets.
- Tickets are sold by the ticketing company (for example, Ticketmaster), not by Velvet. Their terms, prices and fees apply to your purchase.
- Codes are personal. Don’t sell, share or post them unless the Organizer says you can.
- Dates, venues and lineups are set by the Organizer and can change. We are not responsible for show changes, cancellations or refunds.
5. Texts (Velvet Text Alerts)
Velvet Text Alerts are presale codes, on-sale reminders and show announcements for the Organizers and artists you sign up for or follow. If you give your phone number and agree to texts, you agree that Velvet may send you recurring marketing texts from Velvet’s number, including texts sent using automated technology. Agreeing to texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. See how Velvet Text Alerts work.
- Your number. You confirm you are the account holder of the phone number, or have the account holder’s permission. If you change or give up the number, tell us or reply STOP first.
- Stopping texts. Reply STOP to any text to stop all texts from Velvet. We will send one text confirming that you are unsubscribed, then no more unless you sign up again. To stop texts about just one artist, unfollow them on your fan page at my.velvet.live. Reply HELP for help, or email hello@velvet.live.
- Records. We keep an electronic record of when and how you agreed to texts and when you opted out. You agree that this record is valid proof of your consent.
- Delivery. Carriers are not liable for delayed or undelivered messages, and we don’t guarantee that any text will arrive. Your carrier may share information about your number with us or our text provider to prevent fraud and spam.
- Privacy. Mobile numbers and text opt-in consent are not shared with third parties or affiliates for their marketing. The Privacy Policy explains more.
6. Emails
We send emails for the presales you join and the artists you follow. Each marketing email has an unsubscribe link. We may still send messages you need, such as your presale code or a sign-in link.
7. Your information
The Privacy Policy explains what we collect, how we use it, and how we share it with the Organizer of each presale you join. Each Organizer also uses your information under its own privacy policy.
8. Acceptable use
Don’t:
- interfere with the Service, or try to get around rate limits, CAPTCHAs or security
- scrape it, or try to get other people’s data
- sign up in bulk, or sign up to resell codes or tickets
- use it to break the law
9. Ownership
Organizers own their artist names, logos and page content. Capacity owns the Velvet software and brand. You may use the Service for your own personal, non-commercial use.
10. Disclaimers
The Service is provided “as is” and “as available.” To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Service will be uninterrupted or error-free, or that any message will arrive.
11. Limit of liability
To the extent the law allows, Capacity is not liable for indirect, incidental, special, consequential or punitive damages, or for lost tickets, lost opportunities or lost profits. Our total liability to you for any claim about the Service is limited to $100. Some places don’t allow these limits, so they may not apply to you.
12. Indemnification
To the extent the law allows, you agree to indemnify and hold harmless Capacity and its members, employees and agents from claims, losses and costs (including reasonable lawyers’ fees) that come from your misuse of the Service or your breaking these terms or the law.
13. Disputes and arbitration
Please read this section carefully. It affects how disputes are resolved.
- Talk to us first. If you have a problem with the Service, email hello@velvet.live. You and we agree to try to resolve it informally for 60 days before starting a formal case.
- Arbitration. If we can’t resolve it, you and Capacity agree that any dispute about the Service or these terms will be settled by binding individual arbitration, not in court. The arbitration is run by the American Arbitration Association under its Consumer Arbitration Rules, by an arbitrator who can award the same relief a court could for an individual claim. It can be held by video or phone, or in the county where you live. Capacity pays the AAA filing and arbitrator fees beyond what you would pay to file in court, except where the AAA rules let the arbitrator reallocate fees for a frivolous claim. This agreement to arbitrate is governed by the Federal Arbitration Act.
- No class actions. You and Capacity each bring claims only in an individual capacity, not as a plaintiff or class member in any class action, collective action or representative proceeding. The arbitrator may not combine more than one person’s claims.
- Exceptions. Either side may bring an individual claim in small claims court if it qualifies, or ask a court to stop infringement or misuse of intellectual property.
- Opting out. You can opt out of arbitration by emailing hello@velvet.live within 30 days after you first agree to these terms or after the date this section was added (November 2, 2026), whichever is later, with your name and the email or phone number you use with Velvet. Opting out doesn’t affect the rest of these terms.
- Time limit, law and courts. Any claim must be brought within one year after it arises, or it is barred. New York law governs these terms. Claims not sent to arbitration go to the state or federal courts in New York County, New York. If the class action waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
14. Termination
You can stop using the Service at any time, unsubscribe from emails, and reply STOP to texts. We may suspend or end your access, or remove your signups, if you break these terms or to protect the Service, Organizers or other fans. The sections on ownership, disclaimers, limit of liability, indemnification, disputes and arbitration, and these general terms survive after your use ends.
15. Changes
We may update these terms. We’ll post the new terms here with a new date. If the changes are material, we’ll give reasonable notice. If you keep using the Service, you accept the new terms. A change to the arbitration section won’t apply to a dispute you have already told us about.
16. Electronic communications
You agree to receive notices from us electronically, by email, text or on the Service, and that these satisfy any legal requirement that they be in writing. Checking a box or tapping a button to agree, such as agreeing to texts, is your electronic signature.
17. General
- Entire agreement. These terms and the Privacy Policy are the entire agreement between you and Capacity about the Service.
- Severability. If any part of these terms is found unenforceable, the rest stays in effect, and that part is changed only as much as needed to make it enforceable.
- No waiver. If we don’t enforce a term, that is not a waiver of our right to enforce it later.
- Assignment. You may not transfer these terms. We may assign them, for example as part of a merger or sale of the business.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as carrier or network outages.
